Terms of service

These terms govern your use of BrandBid’s paid-placement service and should be read with the leaderboard rules, privacy statement, and acceptable-use policy. By submitting or claiming a listing, or making a payment, you agree to these terms.
Authority and eligibility
You must be able to enter a binding agreement and have authority to submit the destination and supplied content. You are responsible for its accuracy and lawfulness.
The service
BrandBid publishes approved listings in an order determined by verified cumulative payment. Rank can fall whenever another listing reaches a higher total. Placement is advertising, not endorsement.
Founding Brand promotion
The first brand to claim an available free launch spot receives Founding Brand recognition. It is not purchased. Any temporary category placement has a monetary value of zero, is clearly disclosed as promotional, and ends after 30 days or the first successful paid bid in that category.
Price and payment
Prices are in New Zealand dollars. New listings pay their selected total; existing listings pay the positive difference to the requested new total. Stripe processes payment. BrandBid does not store card details.
A verified total remains attached to the listing’s canonical URL when its category changes. No additional payment is required when that existing total already earns category rank #1 in the selected category.
No promised outcome
BrandBid does not promise traffic, leads, sales, reputation, search ranking, or any other business result. A per-listing visit counts an outbound redirect and is not a count of unique people.
Site-wide “online” and “visitors” figures are supplied by DataFast and are approximate analytics indicators. They may be delayed, unavailable, or affected by cookies, privacy tools, blocked scripts, and changes to the analytics service.
Refunds and statutory rights
Being outbid is not a refund event. BrandBid will investigate payment, placement, refund, reversal, and dispute issues in good faith. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under New Zealand law.
Content licence
You retain ownership of submitted content and grant BrandBid a non-exclusive licence to host, reproduce, format, and display it for operating and promoting the service.
Moderation
BrandBid may suspend or remove listings that breach law, these terms, or the acceptable-use policy. Financial records remain in the private append-only ledger.
Liability
Each party is responsible for direct loss that was reasonably foreseeable and caused by its breach of these terms. To the maximum extent permitted by law, neither party is liable for indirect, consequential, special, or incidental loss, or for loss of profit, revenue, goodwill, data, or opportunity. BrandBid’s total liability relating to a paid listing is limited to the amount paid for that listing during the 12 months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, or liability that cannot lawfully be limited or excluded.
Indemnity
You indemnify BrandBid against third-party claims, losses, and reasonable costs to the extent caused by content or destinations you submit, your material breach of these terms, or your unlawful use of the service. BrandBid must promptly notify you of a claim and take reasonable steps to mitigate its loss. This indemnity does not apply to the extent a claim was caused by BrandBid’s breach, negligence, or wilful misconduct.
Disputes and governing law
Before starting formal proceedings, contact hello@brandbid.nz and allow a reasonable opportunity to resolve the dispute in good faith. These terms are governed by New Zealand law, and the courts of New Zealand have non-exclusive jurisdiction. Either party may seek urgent interim relief when necessary.
Changes
Changes will be dated and published here and apply prospectively. Where reasonably practicable, BrandBid will give advance notice of a material change. If you do not agree to an updated term, do not make further payments and contact BrandBid about deactivating your listing. Changes do not rewrite the historical financial ledger.
